SC/ST एक्ट में हुए वो बदलाव, जिनको लेकर मचा है बवाल
सुप्रीम कोर्ट का फैसला
दरअसल, 21 मार्च को सुप्रीम कोर्ट ने अनुसूचित जाति और अनुसूचित जनजाति अत्याचार निवारण अधिनियम (एससी/एसटी एक्ट 1989) के तहत दर्ज मामलों में तत्काल गिरफ्तारी पर रोक लगा दी है. कोर्ट ने फैसला देते हुए कहा कि सरकारी कर्मचारियों की गिरफ्तारी सिर्फ सक्षम अथॉरिटी की इजाजत के बाद ही हो सकती है. जो लोग सरकारी कर्मचारी नहीं है, उनकी गिरफ्तारी एसएसपी की इजाजत से हो सकेगी. हालांकि, कोर्ट ने यह साफ किया गया है कि गिरफ्तारी की इजाजत लेने के लिए उसकी वजहों को रिकॉर्ड पर रखना होगा.
क्या हैं नई गाइडलाइंस?
> ऐसे मामलों में निर्दोष लोगों को बचाने के लिए कोई भी शिकायत मिलने पर तुरंत मुकदमा दर्ज नहीं किया जाएगा. सबसे पहले शिकायत की जांच डीएसपी लेवल के पुलिस अफसर द्वारा शुरुआती जांच की जाएगी. यह जांच समयबद्ध होनी चाहिए.
>जांच किसी भी सूरत में 7 दिन से ज्यादा समय तक न हो. डीएसपी शुरुआती जांच कर नतीजा निकालेंगे कि शिकायत के मुताबिक क्या कोई मामला बनता है या फिर तरीके से झूठे आरोप लगाकर फंसाया जा रहा है?
>सुप्रीम कोर्ट ने इस एक्ट के बड़े पैमाने पर गलत इस्तेमाल की बात को मानते हुए कहा कि इस मामले में सरकारी कर्मचारी अग्रिम जमानत के लिए आवेदन कर सकते हैं.
>एससी/एसटी एक्ट के तहत जातिसूचक शब्द इस्तेमाल करने के आरोपी को जब मजिस्ट्रेट के सामने पेश किया जाए, तो उस वक्त उन्हें आरोपी की हिरासत बढ़ाने का फैसला लेने से पहले गिरफ्तारी की वजहों की समीक्षा करनी चाहिए.
>सबसे बड़ी बात ऐसे मामलों में तुरंत गिरफ्तारी नहीं की जाएगी. सरकारी कर्मचारियों की गिरफ्तारी सिर्फ सक्षम अथॉरिटी की इजाजत के बाद ही हो सकती है.
>सुप्रीम कोर्ट के फैसले के मुताबिक, इन दिशा-निर्देशों का उल्लंघन करने वाले अफसरों को विभागीय कार्रवाई के साथ अदालत की अवमानना की कार्रवाही का भी सामना करना होगा.
अब तक थे ये नियम?
>एससी/एसटी एक्ट में जातिसूचक शब्दों का इस्तेमाल संबंधी शिकायत पर तुरंत मामला दर्ज होता था.
>ऐसे मामलों में जांच केवल इंस्पेक्टर रैंक के पुलिस अफसर ही करते थे.
>इन मामलों में केस दर्ज होने के बाद तुरंत गिरफ्तारी का भी प्रावधान था.
>इस तरह के मामलों में अग्रिम जमानत नहीं मिलती थी. सिर्फ हाईकोर्ट से ही नियमित जमानत मिल सकती थी.
>सरकारी कर्मचारी के खिलाफ अदालत में चार्जशीट दायर करने से पहले जांच एजेंसी को अथॉरिटी से इजाजत नहीं लेनी होती थी.
> एससी/एसटी मामलों की सुनवाई सिर्फ स्पेशल कोर्ट में होती थी.
